Terms & Conditions of Sale

1. Preamble

These Terms and Conditions of Sale govern the contractual relationship between MODERN HOME (the "Seller") and any consumer (the "Customer") wishing to make a purchase on modernhome.fr. Any purchase implies full and unconditional acceptance of these Terms.

2. Products

Products offered for sale are connected smart locks and smart home accessories. Product photographs and descriptions are provided for illustrative purposes and may show slight colour variations due to photographic reproduction. MODERN HOME endeavours to present the essential characteristics of products with the utmost accuracy. Made-to-measure products (such as mosquito screens) are manufactured to the dimensions provided by the Customer, with a manufacturing tolerance of 1 to 2 mm.

3. Prices

Prices are shown in euros, inclusive of all taxes (French VAT applicable). MODERN HOME reserves the right to modify prices at any time. Products are invoiced at the price in effect at the time the order is confirmed. Shipping costs are indicated separately before final order confirmation.

4. Order

Placing an order involves the following steps:

  1. Selecting products and adding them to the cart
  2. Confirming the cart and entering shipping details
  3. Choosing the payment method and confirming
  4. Order confirmation by email

The sale is deemed concluded upon receipt of payment. MODERN HOME reserves the right to cancel any order in the event of stock shortage, dispute relating to a previous payment, or suspicion of fraud.

5. Payment

Payment is due immediately upon ordering. It is secured by Stripe (PCI-DSS). Accepted payment methods include credit/debit cards (Visa, Mastercard, American Express) and any other method offered at checkout. Customer banking data never passes through MODERN HOME servers.

6. Delivery

Delivery terms, timescales and rates are detailed in our Shipping Policy available on the site. MODERN HOME cannot be held responsible for delays caused by the carrier or external events (strikes, adverse weather, etc.).

7. No Right of Withdrawal

Under Article L. 221-28 of the French Consumer Code, the right of withdrawal is excluded for sealed goods that cannot be returned for hygiene or health protection reasons. Smart locks sold by MODERN fall within this category.

Under Article L. 221-28 3° of the French Consumer Code, the right of withdrawal is also excluded for goods made to the consumer's specifications or clearly personalised. Made-to-measure products (in particular mosquito screens manufactured to the dimensions provided by the Customer) can therefore not be returned or refunded. The Customer expressly acknowledges this before placing the order.

As a result, no return or refund will be granted for personal convenience, wrong selection or change of mind after the order has been confirmed.

The only cases entitling a return or refund are defective products, products damaged in transit, or products not matching the order, subject to the conditions detailed in our Shipping & Returns Policy.

8. Legal Warranties

In accordance with French consumer law, the Customer benefits from:

  • The legal warranty of conformity (2 years from delivery)
  • The warranty against hidden defects

In case of non-conformity, the Customer may choose between repair or replacement, or failing that, full or partial refund.

9. Liability

MODERN HOME shall not be liable for indirect damages resulting from use of the products. Our liability is in any event limited to the amount of the relevant order.

10. Data Protection

Personal data collected as part of the order is processed in accordance with our Privacy Policy available on the site.

11. Disputes

In the event of a dispute, the Customer is invited to contact our customer service at modernhomeparis@gmail.com to seek an amicable solution. Failing that, the Customer may have recourse to a competent consumer mediator free of charge. These Terms are governed by French law. In the absence of amicable resolution, the French courts shall have jurisdiction.
